Call for Papers: Penalization of international crimes in national law - Deadline for submissions: 25 May 2021

International law defines international crimes and principles of criminal responsibility for participating in their commission. However, the details concerning penalization of international crimes and subsequent prosecution of perpetrators are left to states (not counting extraordinary measures such as the International Criminal Court or mixed tribunals established on the ad hoc basis).

The states do not always follow international law in shaping and implementing their

national legislation, as they want to recognize the specificity of the circumstances of place and time.


Deviations from the notions/principles adopted in international law can result in diplomatic crises (which was the case e.g. during the negotiations of agreements concerning Extraordinary Chambers in Courts of Cambodia, when Cambodia exercised pressure to adopt the broad definition of genocide) or in proceedings before human rights bodies.


The aim of the conference organized by the Institute of Justice is to contemplate the

following questions:

• To what extent are international crimes recognized in national legislation? How

does national law define international crimes, including both core crimes (i.e. crime

of aggression, genocide, genocide, crimes against humanity, war crimes) as well as

other treaty crimes (e.g. torture or apartheid)? Are there any alterations of

definitions of international crimes and what are the consequences?


• Are there any inconsistencies between international law and national law in terms

of defining principles of responsibility for international crimes?


• Do states take into account the impact of customary law on the shape of international criminal law in framing their national legislation?


• What are the models of criminalization of international crimes and what are their

respective advantages and disadvantages?


• What are the main problems related with the prosecution of international crimes in

national proceedings?


• Should a distinction be drawn between historic and contemporary crimes

concerning their penalization?


• Are there crimes in national law which are considered to have international

character despite the lack of criminalization in international law?


• Are the Nuremberg Principles and principles of the Rome Statute reflected in

national law?


The conference will take place online on 14-15 June 2021. The language of the conference is English.


We invite researchers and practitioners to submit a proposal for a paper related to the above questions. The organizers plan to publish papers in two language versions (English and Polish) in the Publishing House of the Justice Institute (open access mode) by the end of 2021.

• a 500-word max abstract [doc/docx];

W tym roku minęło 15 lat od przyjęcia przez społeczność międzynarodową zasady Odpowiedzialności za ochronę (R2P). Przyjęta w trakcie spotkania na szczycie ONZ zasada stała się wewnętrzną normą Organizacji. Stało się to w czasie jeszcze przyjaznym dla praw człowieka, w pełni rozkwitu liberalnego porządku międzynarodowego (LPM). Przypomnijmy, zgodnie z brzmieniem tej zasady z 2005 r. zgodzono się na – w ostateczności – użycie siły sytuacjach ciężkich i masowych naruszeń praw człowieka, w sytuacjach dramatów humanitarnych. Wraz z kryzysem, a może zmierzchem LPM w kryzysie znalazła się R2P. Stoi za tym przede wszystkim globalna zmiana układu sił na niekorzyść Zachodu. Czy ta zmiana musi pogrzebać R2P i sprawę międzynarodowej ochrony praw człowieka? Czy power politics nieuchronnie zwiększa prawdopodobieństwo naruszeń praw człowieka oraz usunięcia tej problematyki z agendy stosunków międzynarodowych?

Call for Papers: The Communist Crimes – Question of Individual and State Responsibility

The deadline for submissions is 31srMay 2020.

The accountability for communist crimes provokes political discussions and legal problems in many states of the world. Given that most of those crimes can be classified as international crimes, the prosecution should be in the interest of the whole international community. 

There is no international court which would deal with individual responsibility of perpetrators of communist crimes. National courts tend to encounter tremendous problems concerning legal qualification of communist crimes, application of statutory limitations, lack of cooperation with third states, as well as invocation of privileges and immunities of high officials of communist regimes in order to avoid responsibility. In some states (e.g. in Poland) communist crimes, even minor ones, are often qualified as crimes against humanity or genocide. This provokes debates in many instances. In others states, the question of communist crimes is dealt only on the civil claims level or is ignored altogether. Does it mean that victims accept the situation? 
The aim of the conference organized by the Institute of Justice is to contemplate the answers for the following questions:
·     What was the scale and character of communist crimes?
·     In what way are communist crimes qualified in national law?
·     In what way are communist crimes qualified in international law?
·     What are the options to pursue individual responsibility for communist crimes before national and international institutions?
·     Do statutory limitations apply to communist crimes?
·     Can we apply contemporary definitions of international crimes and current standards of attribution of responsibility to perpetrators of communist crimes?
·     What is the experience of national tribunals in judging communist crimes?
·     Is there a possibility to engage international courts in prosecution of communist crimes or pursuit of state’s responsibility for communist crimes? Is there a role for the International Criminal Court, the International Court of Justice, the Human Rights Courts/Committees/Commissions, Arbitral Tribunals?
·     Are the current states/governments responsible for crimes of previous regimes, especially in case of dissolution/secession of a state? 
·     What are the main problems related to pursuit of responsibility of individual persons?
·     What are the main problems related to pursuit of responsibility of states in response to its own citizens’ claims and to citizens of third states?
·     Is it possible to attribute responsibility for communist crimes to legal entities (e.g. communist party)?

The conference will take place in Warsaw on 9-10thNovember 2020, however due to Covid-19 the whole even can be postponed. The language of the conference is English. 

We invite lawyers, historians, and political scientists to submit a proposal for a paper related to the above questions. The organizers plan to publish papers in English and Polish by the end of 2020. The organizers will cover the costs of travel and accommodation of participants up to the agreed limit.

Norweskie Centrum Studiów Humanitarnych oraz Uniwersytet Groningen zapraszają do składania propozycji prezentacji na konferencję: Four year after the Agenda for Humanity : humanitarianism challenged, która odbędzie się 25 marca 2020 r. w Groningen.

Call for Papers: Punishment of Negationism
The deadline for submissions is 30 June 2019

The obligation to punish public condoning, denying or grossly trivialising crimes of genocide, crimes against humanity, war crimes and crimes against peace was imposed on European Union member states by the Council Framework Decision 2008/913/JHA of November 2008 on combating certain forms and expressions of racism and xenophobia by means of criminal law. A similar obligation was also introduced in theAdditional Protocol to the Convention on Cybercrime concerning the criminalisation of acts of a racist and xenophobic nature committed through computer systems (2006). 

Poland subsequently took action with a threefold intention: to implement this obligation; to combat the use of misleading expressions such as “Polish concentration camps” (instead of German Nazi concentration and extermination camps) and to prevent attempts to attribute responsibility for German Nazi crimes to the Polish state and/or nation. The measures included the introduction of new regulations into the Act on the Institute of National Remembrance in January 2018 (see section in Polish Yearbook of International Lawno. XXXVII with a focus on this Act). The new regulations met with severe criticism. Several of them were referred by the President of Poland to the Constitutional Tribunal for further scrutiny or there were repealed by the Parliament. This is an excellent example of the legal and political pitfalls inherent in the attempts to criminalize negationism. In consequence, the question if and in what way negation of international crimes should be addressed by legal measures is of great importance.

ESIL Reflections - zachęcamy do składania tekstów do publikacji

Serdecznie zachęcamy do publikowania krótkich esejów na temat prawa międzynarodowego (3-4 tysiące słów) w cyklu ESIL Reflections (zob. tutaj). To prestiżowa seria, która pozwala na zaprezentowanie swoich poglądów w szerokim gronie internacjonalistów. 

Eseje tamże publikowane z założenia powinny mieć ograniczoną liczbę przypisów. Celem jest zaprezentowanie danej linii argumentacji skupionej wokół jednego zagadnienia, a nie publikacja szeroko zakrojonych analiz, do jakich jesteśmy przyzwyczajeni w periodykach naukowych.

Obecnie zostali powołani nowi członkowie redakcji ESIL Reflections, wśród których znalazła się pisząca te słowa - dr hab. Patrycja Grzebyk obok Federico Casolari, Ellen Hey, Guya Sinclaira oraz Ramsesa Wessela (red. naczelny). Polska członkini służy pomocą w odpowiedzi na wszelkie wątpliwości związane z publikacją na łamach ESIL Reflections.

Każdy zgłoszony tekst (a wcale nie jest ich dużo!) jest omawiany przez członków redakcji co do spełniania kryteriów formalnych i odpowiedniego poziomu merytorycznego, a następnie kierowany do recenzji. Europejski Instytut Uniwersytecki we Florencji zapewnia korektę językową i odpowiada za prace edytorskie.
