Zaproszenie na drugie spotkanie w ramach cyklu wykładów „Contemporary issues of human rights theory and practice. Global, regional and national perspectives” organizowanego przez Katedrę Praw Człowieka UMK.


We are pleased to announce a second guest lecture of our Lecture series „Contemporary issues of human rights theory and practice. Global, regional and national perspectives”. The Lecture series is organized in association with AHRI.
Prof. Miodrag A. Jovanović will be presenting a topic "Jus Cogens: A Complex Case of Constitutional Reasoning in International Law”.

Miodrag A. Jovanović (1971) is Full Professor in Jurisprudence, Faculty of Law, University of Belgrade. He also teaches at the Legal Methods module of the European Master in Legal Theory, at the Goethe University, Frankfurt. His areas of interest are jurisprudence, philosophy of international law, legal theory of collective rights, political theory of multiculturalism, federalism and legal and political nature of the EU. He is a fellow of the Alexander von Humboldt Foundation. He was the 2016 Brandon Fellow of the Lauterpacht Centre for International Law (Cambridge). His internationally published books include: Constitutionalizing Secession in Federalized States: A Procedural Approach (Eleven International Publishing, 2007); Collective Rights – A Legal Theory (Cambridge University Press, 2012) and The Nature of International Law (Cambridge University Press, 2019). His most recently co-edited books include: (with Kenneth Einar Himma and Bojan Spaić) Unpacking Normativity – Conceptual, Normative and Descriptive Issues (Hart Publishing, 2018), and (with Tibor Varady) Human Rights in the 21st Century (Eleven Publishing International and Serbian Academy of Sciences and Arts, 2020)


Jus Cogens: A Complex Case of Constitutional Reasoning in International Law

Article 53 of the Vienna Convention on the Law of Treaties famously introduced a special class of international legal rules – jus cogens norms – without specifying its content. The paper proceeds by adopting the heuristic framework of constitutionalization of international law, arguing that jus cogens norms contribute to at least two constitutionalist functions – that of limiting the international governance and hierarchizing international legal order. Hence, it is possible to argue that jus cogens reasoning is a specific type of constitutional reasoning. Despite stipulated formal qualities of jus cogens norms, in trying to establish their content state actors are in the situation similar to constitutional adjudicators dealing with underdetermined legal content of a constitutional text. What directs the process of jus cogens reasoning is, thus, the particular nature of the subject-matter with which those norms deal. The last part of the paper provides the analytical reconstruction of the jus cogens constitutional reasoning, focusing on the process of ascertainment, which is to be taken by the community of states. It is argued that what ascertainment requires is, inter alia, resorting to a unique interpretative tool – reverse teleological argument – with the use of which the state actor can extract from the fundamental values of international legal order a class of peremptory norms of international law.

About the Lecture Series

 

NCU Human Rights Department is happy to announce a launch of a lecture series „Contemporary issues of human rights theory and practice. Global, regional and national perspectives”. For the last decades, human rights law have been developing and consolidating. Today, IHRL seems to have reached a „critical point” that raises new challenges and problems on a global, regional and national scale. Is IHRL a victim of its own success, does fragmentation require harmonization? Why, and how human rights are being walked back in some European countries? These are just some of the question will try to explore.

 

Our goal is to host one lecture each month, featuring academics, practitioners of international law from governmental service, international organizations and private practice. We welcome all students, academics, practitioners, and civil society. We hope to engage into a meaningful discussion.

About the Lecture

 

„Privatization of Hungarian Universities as a threat to academic freedom”.

 

In this lecture, I address the reforms that aim at transforming the majority of Hungarian public universities into "public interest asset management foundation performing public duty". Regardless of the legal label we attach, these universities become private universities directed by funds that are severely influenced by the governing party, Fidesz. I will present the discrepancy between the arguments of the government and reality, the decision-making process that completely disregards any standards imaginable, and how disagreement and resistance have been expressed.

About the Speaker

 

Tímea Drinóczi is a Full Professor at the Department of Constitutional Law, Faculty of Law, University of Pécs. She will be a Visiting Professor at the Faculty of Law, Federal University of Minas Gerais, Brazil. She served as a Professor at the Department of Public Law, Kenyatta University School of Law, Kenya in 2018-2019, has been a visiting professor in law schools in Plzen, Brno, Cologne, Graz, Istanbul, and Osijek, and lectured in several conferences all over Europe. Tímea is the author or co-author and editor or co-editor of several books and many articles and book chapters. She is a member of the editorial boards of the Polish and Hungarian journals, the corresponding editor of the Vienna Journal on International Constitutional Law, member of the Hungarian Constitutional Law Association, the Advisory Board of the International Association of Legislation, the International Society of Public Law, and research groups of the IACL. She also advises OSCE ODIHR in legislative and constitutional matters.

 

Tímea’s most important books in English are:

Webinarium: The International Criminal Court vs. Powerful States: The United Kingdom/Iraq Preliminary Examination and Beyond 18.02.2021

On 9 December 2020, the Prosecutor of the International Criminal Court, Fatou Bensouda, announced that she would close the United Kingdom/Iraq preliminary examination. The Prosecutor determined that, while there was a reasonable basis to believe that members of the British armed forces had committed war crimes in Iraq, she could not substantiate allegations that the United Kingdom’s subsequent investigations were not genuine, or that potential perpetrators had been shielded from justice. The Prosecutor’s declination has come under criticism. In particular, questions have been raised about the British government’s history of ignoring abuses committed by its own troops, the lack of accountability alternatives for Iraqi victims, and the Prosecutor’s deferential evaluation of the United Kingdom’s domestic proceedings. The panelists will analyze the Prosecutor’s declination and what it means for future investigations against powerful states, in particular the International Criminal Court’s ongoing inquiries involving Israel (in Palestine) and the United States (in Afghanistan).

Call for papers: Comarative Law Review

Comparative Law Review zaprasza do publikacji, call for papers publikujemy poniżej.


Comparative Law Review (ISSN 0866-9449) („CLR”) is an open access, peer-reviewed and refereed international journal published by the Faculty of Law and Administration at Nicolaus Copernicus University in Toruń (Poland) since 1989 (with some intervals). The scope of „CLR” includes both private and public law, with particular focus on comparative studies. The Editors encourage authors to submit articles and shorter notes that are interdisciplinary in nature and/or analyse a legal problem from a comparative perspective. We particularly welcome proposals elaborating on how the comparative method is applied in domestic and international law-making and jurisprudence. Consequently, we invite original contributions on public international law and EU law. By the same token, we welcome papers dealing with all fields of domestic law, legal theory and philosophy, as well as history of law.

The journal is published in both print and online versions. It is a fully open access journal, thus the articles published in CLR are easily searchable on the Internet (via Google Scholar, BASE, etc.). There are no charges for article processing, article submission or open-access policy for the authors or their institutions. 

The journal is now indexed with and included in Index Copernicus Journals Master List as well as in ERIH PLUS and CEEOL.

CLR publishes articles, essays, shorter notes, case notes, commentaries, case studies and book reviews. We welcome contributions in English and – after consultation with the Editors – in German or French (editorial instructions for Contributors are available at http://apcz.umk.pl/czasopisma/index.php/CLR --> Author Guidelines).

Since 2017 CLR is yearbook: vol. 23 of the journal was published in December 2017 and the current volume (no. 24) in January 2019. 

The deadline for submissions for vol. 25 of CLR is June 30, 2019.

Kolejna edycja konkursu Polonia organizowanego przez Lauterpacht Centre for International Law

Lauterpacht Centre przy Uniwersytecie w Cambridge ogłosił właśnie kolejną (drugą) edycję konkursu Polonia. Jest to stypendium w kwocie 2000 funtów, które ma pokryć koszty pobytu w Cambridge naukowca przez okres od 4 do 13 tygodni w 2019 roku. W przeciwieństwie do poprzedniej edycji ta kierowana jest także do obywateli Izraela.

Termin przysyłania aplikacji upływa 17 września, wszystkie szczegóły dostępne są na stronie centrum.

Zaproszenie na debatę "Jakim prawem...? rzecz o prawie międzynarodowym po aneksji Krymu"

W imieniu organizatora Centrum Polsko-Rosyjskiego Dialogu i Porozumienia zapraszamy na debatę, która odbędzie się w środę 10.01.2018 r.


Rosyjskie stanowisko względem prawa międzynarodowego oraz zasady integralności terytorialnej swoich sąsiadów stało się żywotną kwestią polityczną, prawną i interesującym problemem badawczym. Krym został nielegalnie zaanektowany – jakie są prawne możliwości wyjścia z tej sytuacji? Co może prawo międzynarodowe, a czego nie należy od niego oczekiwać? Czy możliwy jest porządek międzynarodowy bez przestrzegania tego prawa? 

Przyczynkiem do dyskusji będzie książka „The Case of Crimea`s Annexation Under International Law” – nowość wydawnicza Centrum Polsko-Rosyjskiego Dialogu i Porozumienia, Instytutu Nauk Prawnych Polskiej Akademii Nauk oraz Wydawnictwa Naukowego Scholar. Do debaty zaprosiliśmy trzech profesorów prawa międzynarodowego: Władysława Czaplińskiego (INP PAN, jeden z redaktorów opublikowanego tomu), Mykołę Gnatowskiego (Uniwersytet Tarasa Szewczenki w Kijowie) oraz Dino Kritsiotisa (Uniwersytet w Nottingham). Dyskusję poprowadzi dr Sławomir Dębski (Polski Instytut Spraw Międzynarodowych).

Zaproszenie na konferencję: Wojny zachodu. Fiasko dobrych intencji?
