Teksty mogą dotyczyć m.in. następujących zagadnień:

• how can international lawmaking on pandemic response align itself with constitutional and other internal norms, as well as international human rights obligations, regarding the right to health and related economic and social rights?
• how can international lawmaking on pandemic response strengthen global health governance in ways that mitigate, rather than reinforce, colonialist structures?
• how can a pandemic treaty address the needs for sharing scientific research and pooling technology and know-how in diagnostics, therapeutics, and potential vaccines in future epidemics, and how might it address potential conflicts with the TRIPS agreement?
• how can international lawmaking advance financing mechanisms for resilient health systems and pandemic preparedness that go beyond rhetorical invocations of solidarity and avoid the pitfalls of previous models of development finance?
• how can international lawmaking best incentivize transparency and guarantee independent verification?
• what provisions, procedures, and mechanisms are best suited for enforcement of an instrument on pandemic preparedness?
• how can international lawmaking more effectively address and limit the use of extraordinary powers invoked in the name of public health, which have been widely abused during COVID-19?
• to grant legitimacy to the process of international lawmaking, what are the minimum requirements for representation and participation from varied constituencies (including civil society) both within and across countries of differing resource levels?

Zgłoszenia (abstrakt do 200 słów wraz z notką biograficzną do 100 słów) należy przesyłać do 19 lipca.

Wybrani autorzy będą zaproszeni do przesłania tekstów o objętości do 1000 słów, a zainteresowni będą mogli rozwinąć swoje prace w ramach Max Planck Research Paper Series.

Call for papers: Human Rights in Pandemic Times Political Exceptionalism, Social Vulnerability & Restricted Freedoms (wrzesień 2021 r.)

W dniach 6-7 września 2021 r. w Brukseli odbędzie się sympozjum pt. "Human Rights in Pandemic Times Political Exceptionalism, Social Vulnerability & Restricted Freedoms: Comparative and interdisciplinary analyses".

Organizatorzy przewidują następujące panele:

1. Setting up and deploying a regime of exception: special powers, state of emergency and democratic control.

2. Justice 2.0 in times of lockdown: Fundamental principles and procedural safeguards under strain.

3. Pandemic and occupational vulnerability: what can economic, social or cultural rights do?

4. The effectiveness of the right to protection of personal data in the fight against the pandemic.

5. Civil society and the pandemic: mobiliations in times of lockdown.

Zgłoszenia (abstrakt do 500 słów wraz z CV) należy przesyłać do 15 grudnia br. wraz z informacją czy jest się zainteresowanym fizycznym uczestnictwem w sympozjum w Brukseli czy udziałem w wydarzeniu w formie online.

Przewidziana jest publikacja pokonferencyjna.

Redakcja blogu prowadzonego przez British Association of Comparative Law zaprasza do przesyłania propozycji postów dotyczących walki z COVID-19 w kontekście prawnoporównawczym.

Teksty powinny dotyczyć następującej problematyki:

• risks and legal techniques dealing with risks (medical risks, financial risks, travel related risks, mental risks, risks of fake news spreading on social media, risks prevention, risk assessment, torts, etc.) : how does the approach to risks in a given country (or entity) help us better understand globalisation and national cultures? Can different models be identified?
• comparison on protecting vulnerable people (how vulnerable people are understood in this crisis: this would include the vulnerable categories regarding their physical conditions but also women and domestic violence, the homeless, inmates, refugees etc.). How the World Health Organisation’s definition of ‘vulnerability’ shapes who is understood to be “vulnerable”?
• comparison with previous experiences of crisis in a given country: current governments often do not reinvent the wheel in dealing with the covid-19 crisis. They go back to previous crises to address the current one. How do they do that? Which types of previous crisis? Is this self-evident regarding the subject-matter (due to being related to a crisis arising from food poisoning or disease) or because of the power needed by the government (state of emergency type of reaction)?
• research designs (and comparisons) in times of crisis: lessons from elsewhere can be tempting to gain time or to address lack of domestic expertise, but should the government and their experts not make basic checks before looking elsewhere for inspiration? How can/should this be done? Can comparative lawyers contribute to the WHO’s thinking here in the sense that uniform broad guidelines may actually be problematic in various ways as they do not address local specificities (needs or expertise etc.) or how regulators, national government, private organisations develop their short- and longer term responses to the crisis?
