Call for abstracts "Migration and Culture: Implementation of Cultural Rights of Migrants"

Włoska Rada ds. Badań Naukowych oraz Wydziały Prawa Uniwersytetów w Neapolu, Katanii i Foggi zapraszają do przesyłania propozycji rozdziałów przeznaczonych do publikacji w książce pt. "Migration and Culture: Implementation of Cultural Rights of Migrants".

Propozycje (streszczenia) rozdziałów, w języku angielskim lub francuskim, należy przesyłać do dnia 15 października 2020 r. na adres: migrationandevelopment@gmail.com.
Redaktorzy podejmą decyzje dotyczące wyboru tematów do dnia 30 października 2020 r.
Ostateczny termin składania gotowych rozdziałów to: 15 lutego 2021 r. Wszystkie teksty zostaną poddane procedurze recenzyjnej.

Monografia będzie opublikowana w formule Open Access w połowie 2021 r.

Call for papers: On-line Workshop "15 years of the Convention for the Protection and Promotion of the Diversity of Cultural Expressions and Lessons for New Ways of International Law-Making: Actors, Processes, Impact"

ESIL Interest Group on International Law of Culture zaprasza do nadsyłania zgłoszeń na wirtualne warsztaty pt. "15 years of the Convention for the Protection and Promotion of the Diversity of Cultural Expressions and Lessons for New Ways of International Law-Making: Actors, Processes, Impact", które odbędą się w dniu 9 września br.

Organizatorzy są w szczególności zainteresowani następującymi tematami wystąpień:
1. Is this “best practices” approach more adequate –in terms of effectiveness or in other terms – than a more classical oversight mechanism? A comparison could be made with other UNESCO Conventions, for instance. 
2. Can this kind of “best practice” approach contribute to losing focus from one of the main objectives of the Convention, which is the respect of the obligation to promote and respect cultural diversity in the negotiation of free trade agreements? Can this kind of analysis contribute to offering new lenses for the debate on fragmentation of international law? 
3. How can the relationships between civil society organisations and States Parties promoted by the Secretariat of the Convention be assessed? What is the role of civil society in implementing the Convention, and how to value its participation in the meetings of the Committee in terms of representativity or others? 
4. Is it possible to identify a kind of emerging transnational regional (or local) law on cultural diversity? 
5. What is the role played by some private institutions, such as the Internet Corporation for Assigned Names and Numbers (ICANN), which are not subject to international public obligations but have a fundamental role in the diversity of cultural expressions? This angle is particularly relevant taking into account that the majority of cultural products are transmitted online nowadays. 
6. While the EU has always been one of the major actors in regional and global promotion of the Convention, the nature of its engagement has considerably evolved. To what extent the Convention has affected the EU’s international law-making praxis? 
7. Whether and how is the Convention used in making international economic agreements? There is increasing reference to the Convention in different bilateral and regional agreements, including those promoted by the EU. What do these practices tell us about the (real) implementation of the Convention’s goals? Is there any role assigned to non-state actors in the creation and/or implementation of these agreements? 
8. What is the real impact of the projects financed by the International Fund of Cultural Diversity measured against the main objective of the Convention, namely, to contribute to a more balanced presence of cultural products in the international sphere in terms of cultural diversity? 
9. What are the advantages and disadvantages of linking the Convention with other international instruments or agendas, for instance the 2030 Agenda of Sustainable Development, which would find its basis in Art. 13 of the Convention? 
10. What is the Covid-19 crisis putting in relief about the need of measures such as those foreseen in the Convention? How can the objectives of the Convention be promoted in the post-Covid-19 global landscape?

Call for Abstracts "Searching Solidarity for Fighting against Cultural Exclusion towards Migrants and Refugees in Europe in Times of Populism", ESIL Research Forum (Katania, 23 kwietnia 2020 r.)

W dniu 23 kwietnia 2020 r., podczas ESIL Research Forum w Katanii (Włochy), ESIL Interest Group on International Law of Culture będzie gospodarzem warsztatów na temat “Searching Solidarity for Fighting against Cultural Exclusion towards Migrants and Refugees in Europe in Times of Populism”. Organizatorzy serdecznie zapraszają młodych naukowców do nadsyłania propozycji referatów. British Institute of International and Comparative Law, wspólnie z Coventry University oraz redakcją Asian Yearbook of Human Rights and Humanitarian Law, zaprasza do nadsyłania zgłoszeń na konferencję pt. Call for papers: Agora "Culture As or Against Sovereignty" (Ateny, wrzesień 2019 r.)

International Law of Culture Interest Group zaprasza na agorę pt. "Culture As or Against Sovereignty", która ma odbyć się w ramach dorocznej konferencji ESIL w Atenach w dniach 12-14 września 2019 r.
Organizatorzy chcieliby, aby podczas agory udało się odpowiedzieć na następujące pytania:
  • What do historical constructions of culture as a means to galvanize self-determination efforts say about the nature of sovereignty in international law?
  • How does the mandate of international organizations in the field of culture frames or approaches sovereignty? 
  • What do current cases like Al Mahdi (International Criminal Court) and EC-Seals (World Trade Organization) tell us about the role of culture in enforcing or creating exceptions to universal international law?
  • Is there a general cultural exception in international law?
  • Can culture make a claim to universality that facilitates its existence as an international regulatory object? Does it need to make such claim?
  • How does the right to cultural life in international human rights law make sense of sovereignty, given international human rights law is premised on the idea of a challenge to unbridled state sovereignty?
  • What does the concept of cultural diversity recognized in international law mean for sovereignty?
  • Who defines culture in international law? How the human right of individuals and peoples to define their cultural identity and practices affect sovereignty in the cultural sphere?

Call for papers: The United States-Mexico-Canada Agreement

Czasopismo "Transnational Dispute Management" zaprasza do nadsyłania artykułów do swojego specjalnego numeru, który ukaże się pod hasłem " The United States-Mexico-Canada Agreement".
Tematy, których mogą dotyczyć teksty to, przykładowo:
  • The convergence or divergence of international trade and/or investment law trends in the USMCA
  • The balance struck within a USMCA chapter between measures designed to facilitate international trade and/or investment and a host state's sovereign right to regulate to achieve legitimate policy objectives, such as the protection of human rights, health, the environment, public morals, and culture
  • Intended and unintended legal consequences of the USMCA's tight "rules of origin" provisions on labor markets
  • The facilitation or impairment of market access for trade in services under the USMCA
  • The treatment of technical barriers to trade, such as labelling and manufacturing standards or food safety measures under the USMCA versus WTO agreements and mega-regional trade treaties like the CPTPP
  • Supply chain risks and opportunities created by the USMCA for multi-national organizations and/or signatory states and state-owned enterprises
  • The impact of the USMCA on transformative/disruptive technologies, e-commerce or business models and related domestic law
  • Reconciling the parties' rights and obligations under the USMCA with their other international trade and/or investment law treaty obligations
  • Various aspects of the investment chapter including investor's rights
  • Procedural and remedial advantages and disadvantages of the USMCA's dispute resolution provisions as compared to other international trade and/or investment law treaties.

Do 15 października br. można przesyłać propozycje tekstów do książki "Intersections of Law and Culture at the International Criminal Court", powstającej pod redakcją dr Brianne McGonigle Leyh i dr Julie Fraser z Netherlands Institute of Human Rights oraz Montaigne Centre for Rule of Law and Administration of Justice, działających przy wydziale prawa Uniwersytetu w Utrechcie.
Abstrakt powinien mieć nie więcej niż 400 słów, a ostateczny tekst nie więcej niż 8.500 słów.

Call for Papers - Intangible Cultural Heritage – Successes, Problems and Challenges 10 Years After the Entry into Force of the UNESCO 2003 Convention

Komitet Redakcyjny półrocznika "Santander Art and Culture Law Review" (SAALCR) zaprasza do przesyłania artykułów do kolejnego numeru tego czasopisma (2017, t. 3, nr 2). Temat tego numeru dotyczy prawnych i społecznych aspektów funkcjonowania Konwencji UNESCO w sprawie ochrony niematerialnego dziedzictwa kulturowego, sporządzona w Paryżu dnia 17 października 2003 r. (Dz.U. 2011 nr 172 poz. 1018), w ciągu ostatniej dekady.

Nowa książka naszego redakcyjnego kolegi: Cultural Rights as Collective Rights. An International Law Perspective, Brill, 2016

Nakładem prestiżowego wydawnictwa Brill ukazała się właśnie książka pod redakcją dr Andrzeja Jakubowskiego, jednego z autorów naszego bloga, zatytułowana "Cultural Rights as Collective Rights. An International Law Perspective". Autorami artykułów zamieszczonych we wspomnianej pozycji są znakomici specjaliści od praw kulturalnych jak choćby Ana Filipa Vrdoljak, Kristin Hausler, czy Federico Lenzerini.


Dodatkowo książkę słowem wstępnym opatrzyła Farida Shaheed - specjalny sprawozdawca ONZ w dziedzinie praw kulturalnych (w latach 2012-2015).
